Welcome to Luciditi. These Terms of Service outline the rules and regulations for using our AI-powered hiring platform, including candidate screening, resume analysis, interview tools, and related recruitment services.
Acceptance of Terms
By creating an account, uploading candidate data, or using Luciditi services, you agree to be bound by these Terms. If you don't agree, please do not use our platform.
Changes to Terms
We may update these Terms at any time. Significant changes will be emailed to active users and posted here with an updated "Last updated" date. Continued use after changes means you accept the new Terms.
Eligibility
You must be at least 18 years old and legally capable of entering contracts. Businesses must have authority to bind their organization to these Terms. You must comply with all applicable employment and data protection laws in your jurisdiction.
Account and Security
- Provide accurate information during registration
- Keep your password confidential
- Notify us immediately of unauthorized account use
- You are responsible for all activity under your account
- Maintain appropriate access controls for team members handling candidate data
Candidate Data and Resumes
Ownership and License
You retain ownership of all candidate data and resumes you upload. By uploading, you grant Luciditi a limited license to process this data using our AI services solely to provide screening, ranking, and analysis features. We do not use candidate data to train models or share with third parties except as necessary to deliver the service.
Your Responsibilities
- You warrant you have obtained necessary consent from candidates to process their data
- You will comply with all applicable employment laws, including anti-discrimination regulations
- You won't use Luciditi to make automated hiring decisions without human oversight where required by law
- You are responsible for informing candidates about AI involvement in screening where legally required
AI Screening Services
- AI screening calls and resume analysis provide recommendations, not final hiring decisions
- AI outputs may contain errors; always apply human judgment before making hiring decisions
- We are not liable for hiring decisions made based on AI recommendations
- You must not use AI screening to discriminate against protected classes
- Interview sidekick suggestions are advisory only; interviewers retain full discretion
AI Screening Calls
When using AI screening calls, you agree to:
- Inform candidates that they will be speaking with an AI system
- Obtain candidate consent for call recording where required
- Not use call recordings for purposes beyond hiring evaluation
- Provide human interview opportunities for candidates who request them
Subscription and Payments
- Paid plans billed monthly or annually based on your selection
- Free trials available; upgrade anytime without interruption
- No refunds except as required by law
- Subscriptions auto-renew until cancelled
- Cancellation effective at end of current billing period
- Usage limits (screening calls, resumes processed) reset each billing cycle
Acceptable Use Policy
- Violate employment laws or anti-discrimination regulations
- Process candidate data without appropriate legal basis or consent
- Screen candidates for illegal purposes
- Generate fraudulent job postings or misleading candidate communications
- Attempt to reverse engineer or access our underlying AI technology
- Overload or disrupt our services
- Use screening data to build competing products or databases
Third Party Services
Payments processed via Stripe. AI processing may use third-party providers under strict data processing agreements. Calendar integrations (Google, Outlook) and video platforms (Zoom, Google Meet) are subject to their respective terms. Review our Privacy Policy for details.
Termination
- You may cancel anytime from account settings
- We may suspend/terminate accounts violating these Terms
- Upon termination, you can export your data within 30 days
- Candidate data deleted according to your retention settings and applicable law
- You remain responsible for fulfilling any legal data retention obligations
Disclaimers
Luciditi is provided "as is" without warranties. AI screening and analysis may contain errors or biases. We don't guarantee hiring outcomes or candidate quality. You're responsible for verifying AI recommendations and making final hiring decisions with appropriate human oversight.
Limitation of Liability
To the maximum extent permitted by law, Luciditi is not liable for indirect, incidental, or consequential damages, including but not limited to damages arising from hiring decisions. Our total liability won't exceed amounts you've paid us in the past 12 months.
Indemnification
You agree to indemnify Luciditi against claims arising from your violation of these Terms, your hiring decisions, your failure to comply with employment laws, or your misuse of candidate data.
Governing Law
These Terms are governed by the laws of the Netherlands. Disputes resolved in Amsterdam courts. EU consumers retain mandatory consumer protection rights. Nothing in these Terms limits candidate rights under applicable employment and data protection laws.
